Three things that surprise people

Much of what decides where property ends up is settled long before anyone reads a will. These are the points readers most often tell us they were never told.

  1. A will does not control everything

    Retirement accounts and life insurance policies usually pass to whoever is named on the beneficiary form held by the institution, and that form generally governs whatever a will happens to say.

  2. Beneficiary forms go stale

    Most are filled in once, when an account is opened, and never looked at again. Marriages, divorces, births and deaths all happen without the form updating itself.

  3. Some property never reaches probate

    Jointly titled property and accounts registered as payable on death pass straight to the surviving owner or named person, outside the process that handles the rest of an estate.
